Agreement to Terms & Entity Ownership These Terms of Service constitute a legally binding agreement between you ("User", "you", or "customer") and CardTap ("CardTap", "we", "us", or "our"), operated independently by Tyler Ziegler in Hartney, Manitoba, Canada.
By creating an account, completing registration, publishing a digital card profile, purchasing physical NFC hardware, subscribing to CardTap Pro, or utilizing any feature of the platform, you expressly agree to be bound by these Terms of Service. If you do not agree, do not register, create an account, or use CardTap.
1 Scope of the CardTap Platform
CardTap is a cloud-based Software-as-a-Service (SaaS) identity and digital contact platform offering:
- Digital Business Cards & Personal Profiles: Fast, mobile-optimized digital contact profiles hosted at personalized vanity URLs (
/c/[slug]). - Free vs. Pro Profile Allocation: Free accounts are entitled to 1 active live card profile at any time (users may freely toggle between Business or Personal profiles). CardTap Pro subscribers unlock dual active profiles, allowing both Business and Personal cards to remain live simultaneously with independent vanity URLs.
- vCard 3.0 Contact Export: Instant generation and download of RFC 2426 compliant vCard 3.0 (
.vcf) files directly into mobile device address books (Apple iOS, Google Android, and desktop clients). - Vector QR Code Generator: Client-side generation of high-resolution SVG vector and PNG QR codes, enabling users to download, print, and distribute scannable codes linking to their profiles.
- Interactive Links & Gaming Handles: Integration for social media, websites, messaging, and gaming identities including PlayStation (PSN ID), Xbox (Gamertag), Nintendo (Switch Friend Code), Riot Games (Riot ID), Facebook, Instagram, Snapchat, TikTok, YouTube, Twitter/X, LinkedIn, GitHub, WhatsApp, and custom website URLs.
- Location & Direct Navigation: Turn-by-turn map directions via Google Maps integration.
2 Physical NFC Cards, Key Fobs, Orders & Shipment Tracking
CardTap offers custom physical NFC-enabled hardware, including pre-encoded or blank NFC smart business cards and epoxy NFC key fobs:
- Hardware Specifications: Physical cards and fobs are embedded with high-grade NXP NTAG215 RFID microchips (13.56 MHz, ISO 14443A compliant) compatible with modern iOS and Android smartphones without requiring any third-party app.
- Fulfillment & Shipping: Physical merchandise orders are fulfilled from Manitoba, Canada, and shipped to destinations across Canada and the United States. Accurate customer shipping names, street addresses, and postal/ZIP codes are required at checkout.
- Real-Time Shipment Tracking: Once an order is prepared and handed over to postal or courier services (Canada Post, USPS, or private courier), a tracking number is generated and logged in the customer's CardTap dashboard. Customers can monitor delivery status directly through our tracking integration.
- Warranty & Defective Chip Policy: CardTap inspects physical NFC chips prior to shipment. We provide a 30-day replacement warranty for physical cards or key fobs that fail to scan due to manufacturing defect upon arrival. Damage resulting from bending, water submersion, intentional tampering, or normal wear and tear is not covered.
- Custom Physical Goods Return Policy: Because custom-printed or programmed NFC cards are tailored to the customer's unique vanity slug or branding, physical orders are non-refundable once production has begun, except in the event of manufacturing defect or incorrect fulfillment.
3 In-Browser Web NFC Tag Programming Tool
CardTap provides a free built-in browser-based Web NFC programmer tool:
- Browser & Device Requirements: The Web NFC API is an experimental web standard currently supported on Google Chrome and Chromium-based browsers running on NFC-equipped Android devices. Web NFC is not currently supported on Apple Safari / iOS due to Apple's browser engine restrictions.
- Tag Responsibility: When writing your profile URL to your own third-party tags, stickers, cards, or fobs, you are responsible for ensuring the target media is an unlocked NTAG213, NTAG215, or NTAG216 chip. CardTap is not responsible for tags permanently locked by third-party software or write errors caused by interrupted tap connections.
A. What Google's Review Guidelines Strictly Prohibit: Google Maps and Google Business Profile policies strictly prohibit
"review gating" or selective review solicitation. Under Google's Prohibited and Restricted Content policies:
- Merchants and businesses are forbidden from selectively soliciting positive reviews while suppressing, discouraging, or routing negative reviews away from Google.
- Businesses may not use sentiment questionnaires, rating gates, or multi-step surveys that only display a Google review submission link to users who rate 4 or 5 stars while actively withholding, blocking, or preventing users with 1, 2, or 3 stars from submitting a public Google review.
- Businesses may not offer incentives, discounts, gifts, contests, or payments in exchange for customer reviews.
B. How CardTap Operates & Complies: CardTap provides an optional customer resolution channel ("We would like to make things right" feedback modal) on Business cards. When the 5-Star review filter is enabled:
- Visitors clicking 1 to 3 stars are offered an immediate private direct messaging channel to describe their concern so the business owner can resolve it privately.
- Crucially, CardTap maintains an uninhibited, prominent link ("Leave a Review on Google Instead") directly inside the feedback modal, ensuring that visitors are never denied access or blocked from posting their review directly to Google.
- CardTap also allows business owners to disable the 5-star filter at any time in favor of a standard direct Google Review button.
C. Assumption of Risk & Customer Responsibility (At Your Own Risk): The customer expressly acknowledges and agrees that the activation and use of any review filter, sentiment routing, or feedback redirection feature is STRICTLY AT THE CUSTOMER'S OWN RISK.
Google continually updates, refines, and retroactively enforces its Maps and Business Profile review policies. The customer is solely and exclusively responsible for keeping up-to-date with Google's changing policies, Federal Trade Commission (FTC) guidelines regarding endorsements and reviews, the Canadian Competition Act, and all applicable federal, state, and provincial advertising regulations.
Disclaimer of Liability: Under no circumstances shall CardTap, its operator Tyler Ziegler, or any associated service providers be liable for:
- Any suspension, restriction, warning, or permanent ban of the customer's Google Business Profile or Google account;
- Any removal, deletion, or filtering of reviews by Google algorithms or moderators;
- Any reduction in local SEO ranking, Google Maps visibility, or business revenue;
- Any regulatory inquiry, penalty, or legal action initiated by consumer protection bodies or competitors.
If Google modifies its policies, the customer must immediately review and adjust their CardTap card configuration to maintain compliance.
5 Subscription Tiers, Square Billing, Renewal & Cancellation
CardTap subscriptions are processed securely through Square (Block, Inc.):
- Pricing & Currency: CardTap Pro is offered at $10.00 CAD per month (monthly interval) or $99.00 CAD per year (annual interval). All charges are denominated in Canadian Dollars (CAD). Applicable taxes (GST/PST/HST) are calculated at checkout.
- Automatic Renewal: Paid subscriptions automatically renew at the conclusion of each billing period (monthly or annually) using the payment method on file until cancelled by the user.
- Delinquency Lifecycle: If a scheduled renewal payment fails, the user's account transitions to
past_due status. Pro features are temporarily suspended, and an alert is displayed in the dashboard prompting payment method updates. - Downgrade & Single-Card Rule: Upon downgrade to the Free tier or upon extended non-payment, the Free tier limit of 1 active live card profile is enforced. The user's primary card remains active while companion profiles are placed in inactive status.
- Cancellation & Refunds: You may cancel your Pro subscription at any time via your dashboard. Cancellation takes effect at the end of the current pre-paid billing cycle. All subscription fees are non-refundable once billed, except where required by law.
6 Lead Capture & Data Controller Obligations (Business Cards Only)
Lead capture functionality is available exclusively on Business card profiles and is disabled on Personal cards:
- Independent Data Controller: When you enable lead capture, you are the independent Data Controller for visitor contact details (name, phone, email) collected via your digital card.
- Anti-Spam & Privacy Compliance: You agree to collect, handle, and message leads strictly in compliance with Canada's Anti-Spam Legislation (CASL), the Personal Information Protection and Electronic Documents Act (PIPEDA), CAN-SPAM, and GDPR.
- Visitor Skip Option: CardTap always affords card visitors a visible "Skip" option when the lead capture modal appears, allowing them to download your contact vCard without being forced to provide their information.
- Card-Level Privacy Policies: Business cards support customizable or hosted privacy policy disclosures informing visitors how their data is handled.
7 Age-Restricted Content & Personal Cards
Personal card profiles may include links to age-restricted creator platforms (such as OnlyFans or Fansly). Any card featuring adult or 18+ links automatically triggers the CardTap 18+ age verification gate, requiring visitors to verify legal age before viewing the profile. Card owners must ensure linked adult content complies with all applicable child safety, anti-trafficking, and obscenity laws.
8 Acceptable Use & Conduct
You agree not to use CardTap to:
- Impersonate any individual, corporate officer, brand, or entity you are not authorized to represent.
- Transmit phishing links, malicious payloads, scam schemes, fraudulent financial offerings, or deceptive credentials.
- Distribute harassing, defamatory, hateful, or unlawful material.
- Interfere with, flood, reverse-engineer, or compromise the stability and security of CardTap systems.
CardTap reserves the right to immediately terminate or suspend accounts and deactivate digital cards that violate these acceptable use standards without notice or refund.
9 Data Sovereignty, Export & Self-Service Account Deletion
You retain complete intellectual property ownership over your uploaded trademarks, logos, contact information, and imagery:
- Download My Data: You may at any time export a complete archive of your profile configurations, collected leads, customer feedback, and analytics directly from your dashboard in an encrypted ZIP file.
- Self-Service Account Deletion: You have the right to permanently purge your account, digital cards, leads, and associated data at any time through the self-service deletion tool in your dashboard settings.
10 Terms Acceptance at Registration & Timestamp Recordation
To ensure informed consent, CardTap requires all new users to review these Terms of Service prior to account creation:
- Mandatory Scroll-to-End Requirement: The registration interface requires users to scroll to the end of these Terms of Service before the acceptance checkbox and card launch button are enabled.
- Electronic Record of Acceptance: Upon checking the agreement box and submitting registration, an immutable digital audit record containing the exact UTC timestamp (
terms_accepted_at) is recorded in your CardTap user account record.
11 Disclaimer of Warranties & Limitation of Liability
The CardTap platform and physical hardware are provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by applicable law, Tyler Ziegler and CardTap disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
In no event shall Tyler Ziegler, CardTap, or affiliates be liable for indirect, punitive, incidental, special, or consequential damages, lost profits, data loss, business interruption, or Google listing suspensions resulting from the use of this service. Our total aggregate liability shall not exceed the greater of $100.00 CAD or the total fees paid by you to CardTap in the twelve (12) months preceding the claim.
